"Employment Offers" vs. "Recruiting Emails": What's the Difference?

Are "recruiting emails" the same as "employment offers"?  I specifically think NOT, because it's really impossible to make a legitimate offer to someone in a mere email without extensive communication.

A new California law would outlaw all email "employment offers".  What consequences would this have?
