New Jersey Legislators Introduce Immigration Workers Law Similar to Arizona's

New Jersey may soon be implemented a bill similar to the Arizona legislation, the Legal Arizona's Workers Act,  first signed by former Governor, Jane Napolitano, in 2008.

A Quirky Opening in the Newark Job Market

This is one of those stories where it can be seen either as a sad commentary on urban America or a hopeful spot in the American job market.  The Newark, New Jersey City Government approved a new law requiring small restaurants in the city to have an armed guard on the premises, during the evening hours.  This comes in the wake of a drive-by shooting at a Newark restaurant where an off-duty police officer was killed.

Big Dilemma-- Job Applicants with Criminal Records

San Francisco is the latest city to present legislation that would prohibit employers from asking job applicants if they had any prior convictions.  If the legislation is passed, San Francisco will join about twenty one other cities in banning the box, as it is known.   Banning the box refers to the check box on job applications, asking if an applicant has had prior criminal conviction.

The Massachusetts CORI Reform Law Exemplifies the Reviews Required for Background Checks

FTC Questions FCRA Compliance With Social Media Background Checks

A recent FTC blog questions the legitimacy of the social media background checks with regard to Fair Credit Reporting Act compliance. Alabama Passes Tough New Immigration Law

The State of Alabama has passed what some have considered one of the toughest immigration laws in the country. The law was passed initially by a large voting margin and comes in the wake of the recent United States Supreme Court ruling on the Arizona's Legal Worker's Act of 2007 that sanctions businesses for hiring undocumented workers. Businesses in Arizona face fines and even loss of business license for repeated offenses.

Illinois To Deny Workers Comp to Those Who Fail Drug and Alcohol Testing

Illinois has decided to make Workers Compensation benefits more difficult for those  who may be inebriated on the job.  The state has passed the "Presumptive Denial Law."  Which means if you test positive for drugs or alcohol  you are denied your workers compensation benefits.  The State's Governor is expected to sign this legislation, which would take effect September 1st.

E-Verify and the Supreme Court Ruling on the Arizona Legal Workers Act

Workplace Suicides Have Increased

Workplace suicides have matched the record high.   In both 2008 and 2009,  263 persons took their lives on the job.   The year before, 2007, 196 persons killed themselves on the job.  We are not talking about Chinese workers in the iPad factory here.  We are talking about American workers.  And while these are not large numbers, really, they certainly are notable.

Employment Screening and Sealed or Expunged Criminal Records

When conducting county criminal background checks for employment screening purposes, be aware that you, the employer, are hnot suppose3d to consider sealed or expunged records.   This would seem simple t first, as sealed or expunged records should not be returned to you.
