OFCCP - Are you Current on Compliance?

Sometimes, the recruiting and HR industry can get so caught up in our love-affair with social recruiting and new technologies for finding candidates, it's easy to overlook some of the less exciting aspects of sourcing, like legal compliance.

Hard to blame us, right? Because man that stuff is dry. (Apologies, compliance lawyers - I know this stuff is riveting for you, and we thank you for that!)

As great as new recruiting technology can be, it's important for any company who is, or could be, subject to OFCCP regulations to remember to use it in a way that's compliant and traceable for audits.

For example, did you know that a recruiter using only LinkedIn to advertise or search for a candidate could be tagged as non-compliant, because LinkedIn's user-base does not adequately represent candidates across all races?

However, using a consolidated job posting and/or search product or process (of course I include Talemetry Broadcast & Match here) to span websites and databases that are representative of all Americans, and saves your data trail and search terms for audit is A-OK.

It seems overwhelming at first, especially knowing that you can be found non-compliant even if you have the best of intentions. Which is why I'm excited to share that one of our partners, America's Job Exchange, is hosting a webinar tomorrow to help you navigate the OFCCP's newest initiatives:

Shafeeqa Watkins Giarratiani, Senior Associate for Fulbright & Jaworski LLP and accomplished author on OFCCP compliance, will explain the OFCCP’s new proposals with regards to affirmative action towards individuals with disabilities and veterans, and provide a comprehensive overview of how pay audits are really being handled by the OFCCP. Rathin Sinha, President of America’s Job Exchange, will join Shafeeqa to offer practical tips and concrete solutions for what your organization needs to do prepare for an audit, or handle a current audit.
