The legal banning of same sex marriage

In California, Arizona and Florida...have people nothing better to do?

We've talked about this for years in recruiting and how inane laws like this will impact recruiting - an entire pool of talent pissed off and possibly looking for another place to live or turning down offers. Shameful.

This will eventually have to be settled by the Supreme Court and I'd rather wait on that until my man, President Elect Obama gets to put some people on that once noble and now corrupt institution... IMNSHO, marriage should not be validated by the state at all... You should be able to set up legal partnership arrangements, from 2 people of the same sex, to a 50 year old man still living with his 70 year old mom, who, for all intents and purposes are already married in all way but one.... If you chose to have a ceremony in another institution, that's your business. Which is more dangerous to society, 2 men who have been together 20+ years, or what goes on in Hollywood "marriages"?

Heather, Obama will be selecting 3 justices to the Supreme Court - toss your hat into the ring!

Realistically, the court will throw it back to the states to decide. That's another 2 cents; we're up to 6.

Steve, I don't think this one is going to get tossed back to the State Courts, and the precedent I'd give is Roe V. Wade.... Some issues MUST have Federal mandates... Again, I don't want to go there though until the new Justices are named. I know which way Thompson, Scalia, Roberts ET AL. will vote....

Similar issues have been tossed back to the States before; with gay advocates filing suit to overturn prop 8 in California, it's only a matter of time before it does make it up the chain. I still feel that the current court will toss it back.

I'm wondering if SHRM, NAPS, et. al. are going to recognize that laws such as this actually denude our humanity & effectiveness and will take a formal stance. How some groups toout their diversity on one hand and fall silent on other similar issues is anathema to me...
