Collar control returning to CEO; alternative proposal fails

Despite a last-minute alternative proposal including an acquisition offer, Collar's creditors have today voted in favour of the deed of company arrangement proposed by its CEO. As [previously reported](81740), administrator David Ross of I&R Advisory had recommended to creditors that they approve the DOCA, under which CEO Ephram Stephenson agrees to pay current and former employees their full entitlements, while unsecured creditors receive only nine cents per dollar they are owed. In today's meeting, a proxy appointed by a former senior manager at Collar proposed an alternative DOCA, under which WA recruiter Mass Resources would take over the business and employ its consultants, and provide a more favourable return to creditors...

WorkPac ordered to match site rates under first SJSP order

WorkPac will be required to pay hundreds of employees up to $20k more per year, under the Fair Work Commission's first regulated labour hire arrangement order. The order, issued late yesterday, will cover WorkPac's on-hire employees at the Batchfire Callide Management open-cut coal mine in Biloela, Queensland. WorkPac currently supplies about 324 production workers to the mine. According to the MEU, which [brought the application](81592) under the Fair Work Act's new 'same job, same pay' (SJSP) laws, WorkPac employees at the mine generally receive between $10k–20k less per year than Batchfire's direct employees...

HR officer wasn't forced to resign over "illegal instruction" to discriminate

An HR officer who claimed she was forced to quit after being "instructed" to discriminate against women actually "misconstrued" the situation, the Fair Work Commission has found. <!--MORE--> The Uconnex HR compliance officer claimed unfair dismissal following her resignation late last year, but the employer objected, arguing her decision was voluntary. The Commission heard that in early December, the HR officer recruited an employee to start work as soon as possible. When it came time to onboard the new recruit on 14 December, the employer discovered she had given birth two days prior and therefore wasn't fit for duties at that time...
