Time's Up for H-1B Petitions

As expected, the Fiscal Year (FY) 2014 H-1B visa cap was met less than a week after U.S. Citizenship and Immigration Services (USCIS) began accepting petitions.

H-1B visas are issued to allow employers to hire foreign workers with specialized knowledge or technical expertise in disciplines such as science, engineering, and computer professions.  The USCIS sets a cap each year for how many H-1B visas it will issue.

Exempt, non-Exempt, contrac employee, independent contractor & lease staffing employee

Regardless of your position it is very important to fully understnad the difference between various employment statuses.

Employee status is defined by both IRS code and DOL laws.

Non-exempt simply means the employee is not exempt by DOL from the employer paying overtime. They may work for the client company or a third-party provider.

Isn’t it amazing how the simple beauty of the sun shining can change our outlook? After a long difficult winter I understand the phrase “hope springs eternal.”

A year ago my son Benjamin wrote the following poem. This wasn’t at school nor was it for an assignment. While in our hotel in NYC, he grabbed a scratchpad and jotted this down in a matter of minutes.
